1. Agreement to these terms
These terms apply to every booking made with Nepali Driving School (“we”, “us”, “our”), whether online, by phone or in person. By creating an account or making a booking you agree to them. If you are booking for someone else — for example, a parent booking for a learner — you agree on their behalf and are responsible for making sure they follow these terms.
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law.
2. Your account
You must give us accurate details and keep them up to date — especially your phone number and pick-up address, so your instructor can find you. Keep your password private; you are responsible for bookings made from your account. We may suspend accounts that are used fraudulently or in breach of these terms.
3. Bookings and payment
- A booking is confirmed only once payment is received, or once lesson hours from a package you have already paid for are allocated to it.
- Prices are shown in Australian dollars and include GST where applicable. Any card processing fee is shown before you pay.
- Package hours are for the learner named on the order and cannot be transferred without our agreement. Any expiry or usage conditions are shown when you buy the package.
- Time slots are held for you only while you complete checkout. If a slot is taken by someone else before payment finishes, we will ask you to pick another.
4. Cancelling and rescheduling
You can cancel or reschedule a lesson free of charge at least 24 hours before the lesson starts. You can do this from your account or by contacting us.
If you cancel with less notice than that, fail to attend, or are not at the pick-up point within 15 minutes of the start time, the lesson may be charged in full or deducted from your package. We may waive this in genuine emergencies — please contact us as soon as you can.
If we need to cancel or reschedule — for example, because of instructor illness, severe weather or vehicle issues — we will offer you a new time or a full refund for that lesson.
5. Refunds
Unused package hours may be refunded on request, less any discount you received for buying a package and any lessons already taken at the standard single-lesson rate. Approved refunds are returned to the original payment method. This does not limit your rights to a refund under the Australian Consumer Law if a service is not provided with due care and skill.
6. During your lesson
For every lesson you must:
- bring a current, valid learner or provisional licence for the vehicle type;
- wear glasses or contact lenses if your licence requires them;
- be free from alcohol, drugs or medication that may affect your driving, and be fit to drive;
- wear suitable footwear and follow your instructor’s directions at all times.
Your instructor may refuse to start, or may end, a lesson if they reasonably believe it is unsafe to continue. Where this is because you did not meet the requirements above, the lesson is charged in full.
Lesson time includes pick-up and drop-off at the addresses you give us. Lessons that start late because of us are extended or credited.
7. Driving test packages and test vehicle hire
You are responsible for booking your driving test with Service NSW unless your package says otherwise, and for bringing the documents Service NSW requires on the day.
A test vehicle is provided only if the vehicle and instructor are available and the vehicle meets test requirements on the day. Test vehicle hire offers may have their own additional terms, which are shown and must be accepted before you book. We cannot guarantee a pass, and test fees paid to Service NSW are not refundable by us.
8. Vehicle damage and fines
Our vehicles are dual-controlled and insured. You are not liable for damage during a lesson unless it results from your deliberate or reckless conduct, or from breaching the requirements in “During your lesson”. Any traffic or parking fine incurred because you disregarded your instructor’s directions may be passed on to you.
9. Conduct
We expect respectful behaviour from learners, parents and instructors alike. We may cancel future bookings, with a refund of unused paid lessons, if a customer is abusive, threatening or discriminatory towards our staff.
10. Our liability
To the extent permitted by law, we are not liable for any indirect or consequential loss, including lost income or travel costs, arising from a cancelled or rescheduled lesson or test. Where our liability for a failure to comply with a consumer guarantee can be limited, it is limited to supplying the service again or paying the cost of having it supplied again.
11. Website use
Content on this website, including text, logos and images, belongs to Nepali Driving School or its licensors. You may not copy or reuse it for commercial purposes without our permission, or attempt to interfere with the site or its booking system. Information on the website is general and may change; prices and availability are confirmed at checkout.
12. Privacy
We handle your personal information in line with our Privacy Policy.
13. Changes and governing law
We may update these terms from time to time. The version in force when you make a booking applies to that booking. These terms are governed by the laws of New South Wales, Australia, and you submit to the courts of that state.
